Terms of Service

Welcome to Vernota. These Terms of Service (“Terms”) govern your access to and use of the Vernota mobile application, website (vernota.app), and related services (collectively, the “Service”).
The Service is owned and operated by Bartłomiej Nycz.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
01 Eligibility and Age Requirements
You must be at least 16 years old to use the Service. If you are between 16 and 18 years of age, you represent and warrant that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to terminate accounts created by unauthorized minors.
02 Privacy and Data Processing
Your privacy is important to us. How we collect, use, and protect your personal data is described in our Privacy Policy, available at vernota.app/privacy, which is incorporated into these Terms by reference.
03 Accounts and Security
To use Vernota, you must create an account using your email address and a password. You may also create an account or sign in using Google Sign-In. When using Google Sign-In, Vernota receives only your email address and basic profile information necessary for account creation. By using Google Sign-In, you agree that Google's terms of service (policies.google.com/terms) also apply to the authentication process. You are entirely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at contact@vernota.app if you suspect unauthorized access to your account.
04 Vernota is Not a Legal Arbiter (Disclaimer)
Vernota allows you to record statements and generates a SHA256 cryptographic hash to prove that a statement existed at a specific time in its original form.
- Informational Purposes Only: The Service is provided for personal, informational, and entertainment purposes.
- Not a Legal Notary: We are not a legal notary, a court of law, or an arbiter of truth. We do not verify the factual accuracy of any statement you make.
- No Reliance: You acknowledge that you are solely responsible for determining whether and how to use any proof generated by the Service and agree not to rely on the Service as a substitute for legal advice or formal notarization.
- No Legal Guarantee: We make no representation or warranty that the cryptographic hashes or digital proofs generated by Vernota will be admissible as evidence in any court of law, legal dispute, or formal proceeding.
05 Data Retention and the Public Proof Archive
When you create a statement, Vernota generates a cryptographic hash.
- Account Deletion:If you delete your account, your profile, statements, uploaded images, and active public proof links (vernota.app/proof/{token}) will be permanently deleted from our primary databases, and shared links will no longer function.
- Permanent Public Archive: To ensure the integrity of the proof system, Vernota automatically commits cryptographic hashes to a public GitHub repository daily. The committed hashes are anonymous and do not contain readable statement content or personal data. Once a hash is committed to this public archive, it cannot be modified or deleted, even if you delete your Vernota account. By using the Service, you acknowledge and agree to this permanent, decentralized anchoring process.
06 User-Generated Content
You retain all ownership rights to the text, images, and other data you submit to the Service (“User Content”). By creating a public proof link, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, and publicly display your User Content solely for the purpose of operating and providing the Service.
07 Acceptable Use Policy
We maintain a zero-tolerance policy for abusive, illegal, or infringing content. You agree that you will not use the Service to upload, create, or share any content that:
- Is unlawful, harassing, defamatory, abusive, threatening, obscene, or hateful.
- Promotes violence, discrimination, or illegal activities.
- Contains child sexual abuse material (CSAM) or explicit sexual content.
- Infringes on the intellectual property rights, privacy rights, or publicity rights of others.
- Contains malware, viruses, or attempts to bypass our security systems.
We reserve the right, at our sole discretion, to remove any User Content, revoke public proof links, and permanently ban any account that violates these rules, without prior notice.
08 Reporting Abuse and Illegal Content (DSA Compliance)
We comply with the EU Digital Services Act (Regulation (EU) 2022/2065). As a micro-enterprise, certain provisions of the DSA may not apply to us. If you encounter content on a Vernota public proof page that violates these Terms or constitutes illegal content, you must report it to us immediately by using the “Report Abuse” button on the proof page or by emailing contact@vernota.app with the URL of the offending content. We will promptly investigate and take appropriate action.
09 Subscriptions, Payments, and Refunds
Vernota offers both free and paid subscription tiers (such as “Founding Member Premium”).
- Free Tier: The free tier is available to all registered users and is subject to statement limits described within the app (currently limited to 10 active statements).
- App Store and Google Play: If you purchase a subscription through the Apple App Store or Google Play Store, your payment is processed and managed entirely by Apple or Google.
- EU Digital Content Waiver: By purchasing a subscription, you expressly request immediate access to digital services and acknowledge that you lose your right of withdrawal once the service performance has begun.
- Cancellations: You may cancel your subscription at any time through your Apple ID or Google account settings.
- Refunds: Because payments are handled by third-party platforms, we cannot process refunds directly. All refund requests must be submitted to Apple or Google and are subject to their respective terms and conditions.
10 Modification and Termination of Service
- Service Modification: We reserve the right to modify, suspend, or discontinue any part of the Service at any time without liability. This includes, but is not limited to, changing the hash format, removing the GitHub anchoring system, discontinuing public proofs, or discontinuing the Service entirely.
- Account Termination:We may suspend or terminate your account and your access to the Service at any time, for any reason, including a breach of these Terms. You may also delete your account at any time using the “Delete Account” feature within the app.
11 Indemnification
You agree to defend, indemnify, and hold harmless Bartłomiej Nycz and Vernota from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your User Content;
- Your violation of these Terms;
- Your misuse of the Service; or
- Your infringement of any third-party rights.
12 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13 Limitation of Liability and Force Majeure
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BARTŁOMIEJ NYCZ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to server outages, third-party service failures, natural disasters, or other force majeure events.
Notice to EU and UK Consumers: If you are a consumer residing in the European Union or the United Kingdom, some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for intentional misconduct or gross negligence. Accordingly, some of the above limitations may not apply to you.
14 Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any legal disputes shall be subject to the jurisdiction of the competent courts in Poland.
If you are a consumer residing in the EU or UK, you may also bring proceedings in your country of residence, and you will benefit from any mandatory provisions of the consumer protection laws of your country. Furthermore, the European Commission provides an Online Dispute Resolution (ODR) platform for resolving e-commerce disputes, which you can access at: https://ec.europa.eu/odr.
15 Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification and/or email to your registered address. Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms.
